    Insurance is by definition discriminatory. Drivers pay different auto insurance fees due to sex, age, even address, but these are insurance company driven. employer benefit plans are similar except a lot of the internal restrictions are a result of what the employer wants. for example, the employer may specifically exclude chiropractors, orthodontics, brand name drugs, biologic drugs, any drug over an internal maximum of say $5,000 per year. They are all legitimate medical procedures/products, but the employer has asked that they be excluded or limited. so not sure how a so called 'court' will have any sway over the medical dope issue.
